Terms & Conditions of Service
Welcome to the Nimbus Earth Agriculture platform (formerly OPAL). These Terms and Conditions govern your use of the Nimbus Earth Agriculture Progressive Web Application and its related services, which are owned and operated by Blackscape Ltd, trading as Nimbus Earth ("we", "us", "our"). By accessing or using Nimbus Earth Agriculture, you agree to be bound by these terms. If you do not agree, you must immediately cease using the platform.
1. Services provided
Nimbus Earth Agriculture provides agricultural analytics based on satellite observations, including spectral index computations (Sentinel-2) and soil-moisture models (Sentinel-1), alongside meteorological forecasts (Open-Meteo) and historical weather (NASA POWER). The service is designed to support farmers and agricultural consultants. While we strive for precision, satellite data interpretation is an advisory tool — ground verification remains the sole responsibility of the grower.
Weather data by Open-Meteo.com, licensed under CC BY 4.0; forecasts for the UK and Ireland contain Met Office data, licensed under CC BY-SA 4.0. Historical weather data was obtained from the National Aeronautics and Space Administration (NASA) Langley Research Center (LaRC) Prediction of Worldwide Energy Resource (POWER) Project funded through the NASA Earth Science/Applied Science Program.

2. Account access and subscriptions
Access to Nimbus Earth Agriculture is granted to registered, approved subscribers. New accounts are initially marked as
pending status. We reserve the right to approve, reject, block, or limit access to accounts at
our sole discretion. Accounts may be linked to subscriptions hosted on our website, nimbusearth.com.
3. Data and privacy
Our handling of personal data, including the rights available to users, is described in our Privacy Policy.
Permanent deletion warning: under GDPR, you have the right to erase your account at any time. In-app deletion is immediate, irreversible, and permanent. All fields, calibrations, and satellite history will be erased from Firestore. We do not keep offline backup copies of your user data once deleted.
4. Prohibited uses
You agree not to use the platform to:
- Reverse engineer the Kotlin/Wasm calculations, index engine scripts, or client code.
- Access the Copernicus statistics endpoints through automated scraping outside of standard application actions.
- Input fraudulent calibration metrics or false field geometry boundaries.
5. Limitation of liability
In no event shall Nimbus Earth or its suppliers be liable for any damages (including, without limitation, damages for loss of crop yield, business interruption, or loss of profits) arising out of the use or inability to use the Nimbus Earth Agriculture analytics, even if advised of the possibility of such damage.
6. Governing law
These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising out of the services shall be subject to the exclusive jurisdiction of the competent courts.
